1. Definitions
1.1 This website is operated by PlugnMake v.o.f. Throughout the site, the terms, “we”, “us” and “our” refer to PlugnMake v.o.f.
1.2 “You” and/or “Contributor” mean the individual or copyright owner submitting the Contribution. If the Contribution is on behalf of a company, the term Contributor shall also mean the company.
1.3 “Contribution” shall mean any and all original work(s) of authorship including, but not limited to, any source code, object code, patch, documentation, sample, graphic, specification, manual, and other material and any modification or addition to existing work(s), that is intentionally submitted or posted to PlugnMake by Contributor. Submissions clearly marked or otherwise indicated by Contributor as “Not a Contribution” shall be excluded.
2. License
2.1 You grant to us a world-wide, irrevocable, perpetual, non-exclusive, unrestricted license to:
(a) publish and republish the Contribution in any of our web, electronic, and/or physical publications;
(b) use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display the Contribution, or incorporate it in other works, in whole or in part;
(c) use the names and images (if any) that you submit with the Contribution, including names and images identifying you as the author of the Contribution; and
(d) incorporate the Contribution into a product combining text, data, audio, and images in digitized form in such manner as we deem appropriate and to exploit that product,
through any device or medium for electronic, physical or other reproduction, publication, distribution, or transmission, whether now or later known or developed.
2.2 At our request and expense, you will execute and deliver to us all such instruments and take such other actions as may be requested by us to obtain the benefit of and perfect the licenses and consents granted under this document.
2.3 We may publish the Contribution without payment to you.
3. Contribution Acceptance
3.1 You understand that the decision to include the Contribution in any product and/or work lies entirely with us and nothing in this Agreement shall be deemed to require PlugnMake to publish and/or include the Contribution in any product and/or work.
3.2 If we publish the Contribution, we may later edit it or remove it from our website, or otherwise cease publication, at our discretion without notice or liability to you and without limiting our rights under this document.
4. Editorial Amendments
4.1 We may alter grammatical construction, punctuations, and citations to conform to the general style of PlugnMake and accepted grammatical standards. We may also edit the Contribution as we see fit, whether for reasons of length, accuracy, legal reasons (such as potential defamation) or otherwise. We are not responsible to you for a failure to edit, or an inadequate editing of, the Contribution for legal reasons.
4.2 We will not make significant amendments to the Contribution that, in our view, materially alter the underlying message or substantive content of the Contribution without your permission.
4.3 You consent to us amending and publishing your amended Contribution on this basis, despite any moral rights that you otherwise could assert in respect of the Contribution.
5. Copyright
5.1 Copyright in the Contribution will remain with you and/or the person from whom you derive publication or republication rights. Copyright in the form of our publication vests exclusively in us.
5.2 Unless you advice us on submission of the Contribution for possible publication, your Contribution will be published under a Creative Commons – Attribution – Share Alike 4.0 International license. Under the terms of that license, users are free to:
(a) Share— copy and redistribute the material available on this website in any medium or format
(b) Adapt— remix, transform, and build upon the material available on this website for any purpose, even commercially.
As long as they follow the following license terms:
(a) Attribution— Users must give appropriate credit, provide a link to the license, and indicate if changes were made.
(b) ShareAlike— If users remix, transform, or build upon the material, you must distribute your contributions under the same license as the original.
(c) No additional restrictions— Users may not apply legal terms or technological measures that legally restrict others from doing anything the license permits.

5.3 If you require that others may deal with your Contribution under a different Creative Commons license, you must tell us and we will endeavor to accommodate your request.
5.4 If you do not wish that others may deal with the Contribution under a Creative Commons license, you must advise us on submission of the Contribution for possible publication. In these circumstances, our website Terms and Conditions will prohibit reproduction of the Contribution without the written permission of the copyright holder, apart from any fair dealing for the purposes of private study, research, criticism, or review or for site users’ other personal, non-commercial use.
5.5 In any event, we are not responsible to you if a third party reproduces the Contribution or otherwise infringes your rights without our permission.
6. Personal Information
Your submission of personal information is governed by our Privacy and Cookies Policy.
7. Representations and Warranties
7.1 The accuracy of the Contribution, including references and citations, is your responsibility.
7.2 You represent and warrant that the Contribution is your original work(s) of authorship and that you are legally entitled to grant the rights and privileges set forth in this Agreement and are duly authorized to execute this Agreement on behalf of yourself or the copyright owner.
7.3 You represent and warrant that, to the best of your knowledge, the Contribution does not violate any third parties copyrights, trademarks, patents, or other intellectual property rights and that no other person or entity has the right to claim any right related to the Contribution.
7.4 You represent that the Contribution shall include full disclosure and complete detail of any third-party license or any other restriction that the work(s) may be subject to (including, but not limited to, related parents and/or trademarks) of which you are aware and which are associated with any part of the Contribution.
7.5 You agree to promptly notify PlugnMake of any facts or circumstances should any of the foregoing representations become inaccurate in any respect.
7.6 The Contribution shall contain nothing defamatory, false, misleading, or deceptive, and its publication by us is lawful.
7.7 You indemnify us and our directors, officers, employees, and agents against all losses, damages and expenses incurred or suffered directly or indirectly by them as a result of us publishing the Contribution when any warranties is false, misleading, inaccurate or incomplete.
8. Limitation of Liability
Under no circumstances shall PlugnMake be liable to you or any third-party for any reason relating to this Agreement. PlugnMake shall have no liability for any incidental, consequential, special, exemplary and punitive damages, whether such claim is based on warranty, contract, tort (including negligence), or otherwise. This limitation shall apply notwithstanding any failure of essential purpose of any limited remedy and to the fullest extent by law.
9. Entire Agreement
9.1 This is entire Agreement between Contributor and PlugnMake and shall supersede any prior agreements, whether written or oral, relating to the subject matter of this Agreement.
9.2 The effective date of this Agreement shall be the date you click “Submit” in the PlugnMake Contributor Application form.
